Introductory Provisions
These Terms and Conditions together with our Privacy Policy (which you can view by clicking here), govern your access to and use of the Breuninger website, mobile applications that Breuninger owns or controls and makes available to consumers. Access to and use of the services provided through the Website is conditioned upon acceptance of and compliance with these Terms and Conditions. By continuing to browse this website and by accessing or using the services you agree to be bound by these Terms and Conditions.
We recommend all users of <https: www.breuninger.com="" ro=""> to read this Terms and Conditions, which govern the purchase of goods through the Breuninger Online Shop RO, before placing an order. These Terms exclusively govern the purchase relationship between Breuninger and private consumers.</https:>

Section 1 Scope
(1) These Terms and Conditions (“Terms”) exclusively govern the commercial relationship between E. Breuninger GmbH & Co. (“Breuninger”) a company incorporated under German law with its registered seat at Marktstraße 1–3, 70173 Stuttgart, Germany (Commercial Register number: HRB 742367; VAT identification number: DE 147505250; email: onlineshop-ro@breuninger.com; telephone: international: 00800-71 121 100) and any person who orders goods from the selected online sales platform at the internet address www.breuninger.com (Breuninger online shop), specifically through the page dedicated to Romania (“Breuninger Online Shop RO”).
(2) Goods are sold exclusively to private customers acting as consumers, within the meaning of applicable Romanian consumer protection legislation, in particular Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals (“GEO 34/2014”). Sale to merchants or professional for commercial purposes is excluded. The commercial resale of goods purchased through the Breuninger online shop RO is not permitted.
(3) “Goods” as defined within these Terms refers to all products and services that can be acquired as part of an online order in the Breuninger online shop RO.
(4) These Terms and Conditions do not apply to orders that are placed with Breuninger outside of the Breuninger online shop RO.
(5) Breuninger is a professional within the meaning of Romanian and European consumer protection legislation. The commercial relationship between Breuninger and consumers in Romania is governed by applicable Romanian and European Union law, including but not limited to: Government Emergency Ordinance no. 34/2014 (“GEO 34/2014”); Government Emergency Ordinance no. 140/2021 (“GEO 140/2021”); Law no. 365/2002 on electronic commerce; Law no. 296/2004 on the Consumer Code; Regulation (EU) 2016/679 (GDPR); Law no. 190/2018; Law no. 506/2004; Regulation (EC) no. 593/2008 (Rome I); and Regulation (EU) no. 1215/2012 (Brussels I bis);; and Directive (EU) 2024/825 amending Directives 2005/29/EC and 2011/83/EU as regards empowering consumers for the green transition (transposed by OUG 18/2026).
(6) Contractual information presented to consumers in Romania will be provided in Romanian, in an accessible form that can be easily understood by the consumer. The English version of these Terms may be provided in addition, but the Romanian version shall prevail in the event of any inconsistency.
Section 2 Formation of the contract and pre-contractual information
(1) The presentation of goods in the Breuninger online shop RO does not constitute a binding offer to conclude a purchase agreement, but rather an invitation to the consumer to place an order (invitatio ad offerendum) within the meaning of the Romanian Civil Code.
(2) Mandatory pre-contractual information: Before the consumer is bound by a distance contract, Breuninger provides all mandatory pre-contractual information required by GEO 34/2014 in a clear, comprehensible and intelligible manner, including: the essential characteristics of the goods; Breuninger’s full identity and contact details; the total price inclusive of all taxes and additional delivery charges; payment, delivery and performance arrangements, including, where available, eco-friendly delivery options; the existence and conditions of the right of withdrawal, including the model form; who bears the cost of returning goods; the statutory legal guarantee of conformity; and the availability of out-of-court complaint and redress mechanisms.
(3) At the latest at the start of the ordering process, Breuninger indicates any applicable delivery restrictions and the accepted payment methods.
(4) Orders may only be placed by persons of legal age (18 years of age or older) with a delivery address in Romania. Goods are only sold in quantities typical household use.
(5) The minimum order value is 20 euro (or the RON equivalent at the exchange rate of the National Bank of Romania on the date of the order). Any returns, discounts, or other vouchers are not taken into account when calculating the minimum order value.
(6) When you place an order – by clicking on the button “Order with obligation to pay” (Comandă cu obligație de plată) or an equivalent unambiguous formulation – you are submitting a binding offer to purchase. Breuninger will send you an automatic confirmation of receipt by email. This automatic confirmation of receipt merely confirms that your order was received by Breuninger and does not constitute acceptance of your offer.
(7) Breuninger reserves the right, depending on the selected payment method, to check the information you provide with respect to the payment method, its validity and your creditworthiness in this regard, and to decline the acceptance of your offer depending on the result of this check, in compliance with applicable data protection legislation.
(8) The contract with Breuninger is only established once Breuninger confirms the shipment of goods to you in a separate email. The deadline for acceptance is 7 calendar days from receipt of the order. If Breuninger does not confirm shipment within this period, the order shall be deemed declined.
(9) Breuninger will send you confirmation of the contract concluded, on a durable medium, within a reasonable time after conclusion and at the latest upon delivery of the goods, containing all applicable mandatory information required under GEO 34/2014, to the extent not already provided on a durable medium before conclusion of the contract.
(10) If delivery of the goods you ordered is not possible, for example because the goods in question are not in stock, Breuninger will not issue a declaration of acceptance. In this case, Breuninger will inform you without undue delay and will reimburse any payments already received within no later than 14 calendar days from the date on which Breuninger becomes aware of the impossibility of delivery, using the same payment method as the original transaction.
(11) Breuninger will store your order details in accordance with applicable statutory provisions. If you are registered in the Breuninger online shop RO, you can access your order details under “My account”.

Section 3 Right of withdrawal
(1) As a consumer, you are entitled to the following statutory right of withdrawal under GEO 34/2014:

Right of withdrawal
You have the right to withdraw from this contract within fourteen (14) calendar days without providing any reason.
The withdrawal period is fourteen (14) calendar days from the day on which you, or a third party designated by you other than the forwarding agent, takes physical possession of the last goods ordered. In the case of multiple goods ordered in one order and delivered separately, the period runs from the day you take physical possession of the last good.

of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post, fax or email). You may use the model withdrawal form below, but this is not mandatory. Where Breuninger provides the option of submitting the withdrawal electronically, Breuninger will acknowledge receipt of your withdrawal on a durable medium without delay.

To comply with the withdrawal deadline, it is sufficient for you to send notification that you are exercising the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, Breuninger will reimburse you for all payments received from you, including delivery costs (with the exception of additional costs that result from your selection of a different delivery method other than the cheapest standard delivery offered by Breuninger), without undue delay and in any event no later than fourteen (14) calendar days starting from the date on which we received the notification that you were withdrawing from this contract.
Breuninger will carry out such reimbursement using the same payment method as you used for the initial transaction, unless otherwise expressly agreed with you. Under no circumstances you will be charged any fees as a result to this repayment. Breuninger may withhold repayment until it has either received the returned goods or until you have supplied evidence of having sent back the goods, depending on which occurs first.
You must send back or hand over the goods without undue delay, in any case no later than fourteen (14) calendar days starting from the day on which you notify us that you are withdrawing from this contract to us or Breuninger GmbH & Co., Online Shop Logistics, Breuningerstr. 1, 74343 Sachsenheim, Germany. This deadline is met if you send the goods before the fourteen-day period has elapsed.
Cost of Return: The direct costs of returning the goods shall be borne by Breuninger.
Your Liability for Diminished Value: You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. You will not be liable for any diminished value if Breuninger has not informed you of your right of withdrawal in accordance with GEO 34/2014.

(2) Exceptions to the right of withdrawal:
The right of withdrawal does not apply to distance sales contracts, in accordance with Article 16 of GEO 34/2014, in the following cases:
(a) for the supply of goods made to the consumer’s specifications or clearly personalized;
(b) for the supply of goods which are liable to deteriorate or expire rapidly;
(c) for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery;
(d) for the supply of goods which are, after delivery, by their nature inseparably mixed with other items;
(e) for the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery;
(f) for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts;
(g) for the supply of digital content not supplied on a tangible medium, where performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.
(3) If Breuninger fails to provide the required withdrawal information, the withdrawal period is extended by 12 months from the end of the initial withdrawal period. If Breuninger provides such information within those 12 months, the withdrawal period ends 14 days after the day the consumer receives the information.
Section 4 Voluntary right of return
(1) Apart from the statutory right of withdrawal set out in Section 3, which remains fully unaffected, Breuninger grants you a voluntary right of return under the following conditions. This voluntary right of return gives you the option of withdrawing from the contract within a period of 30 calendar days. This period starts the day after receiving the goods.
(2) To avail of the voluntary right of return, you must send the goods back to Breuninger within the deadline mentioned above.
Return shipment must be directed to the Breuninger address indicated in the return papers enclosed with the delivery.
On-time shipment is sufficient for observation of the deadline.
Breuninger reserves the right to decline returns that do not comply with the requirements set out in this Section.
(3) The voluntary right of return is granted subject to the condition that the goods are in their original, impeccable condition upon return.
However, Breuninger reserves the right, at its discretion, to decline a return or to claim appropriate compensation in the following circumstances:
· the goods are returned without all components (e.g. product packaging, such as protective pouches for shoes, straps, bags, high-quality shoe boxes etc.)
· the goods are not in their original condition (e.g. safety labels or other labels have been removed)
· the goods have deteriorated or been damaged.
If we do accept the returned goods, however, we are entitled to demand an appropriate amount of compensation from you and offset this using any purchase price payments that were already made.
(4) The voluntary right of return is excluded for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Furthermore, the voluntary right of return does not apply for goods that are not prefabricated and which depend on an individual selection or specification from the customer for their production, or which are clearly tailored to the customer’s personal needs.
Finally, the voluntary right of return does not apply for goods that are delivered in sealed condition if the seal was removed or damaged after delivery.
These exclusions apply in addition to, and independently of, the statutory exceptions listed in Section 3(2).
(5) Your purchasing and return behaviour will be reviewed at regular intervals. Should your return rate exceed a return threshold of 90% based on the online purchases made within a period of up to 12 months, Breuninger will contact you in advance in writing to discuss the situation. If no mutually satisfactory solution is found, Breuninger reserves the right to temporarily restrict access to your customer account. Any such measure will be proportionate and communicated to you in advance in writing. You have the right to contest any such decision by contacting Breuninger at onlineshop-ro@breuninger.com. Permanent account closure will only be applied in cases of serious or repeated misuse. This data processing is carried out on the basis of Breuninger’s legitimate interest pursuant to Article 6(1)(f) of the GDPR; further details are set out in Section 13 (Data Protection).
Note: The voluntary right of return is broader than the statutory 14-day right of withdrawal and does not replace it. The statutory right of withdrawal under Section 3 remains fully unaffected.
Section 5 Reservation of title
The goods remain the property of Breuninger until full payment of the purchase price has been received, in accordance with articles 1684 et seq. of the Romanian Civil Code. Until title is transferred, the consumer is not entitled to resell, pledge or otherwise dispose of the goods.
Section 6 Delivery
(1) Delivery through the Breuninger online shop RO is restricted geographically to the territory of Romania. No deliveries will be made to delivery addresses outside Romania.
(2) No delivery exclusions currently apply within Romania. This section will be updated if any exclusions become applicable in the future.
(3) Unless deviating delivery periods (particularly when the express function is selected) are agreed, the delivery period is up to 7 working days from order receipt, unless a shorter period is specified in the order process. In any event, and unless otherwise agreed, Breuninger will deliver the goods without undue delay and no later than 30 calendar days from the date of conclusion of the contract. Where available, eco-friendly delivery options will be offered to the consumer.
(4) If Breuninger fails to deliver within the agreed or statutory period, you are entitled to request delivery within an additional reasonable period. If Breuninger fails to deliver within that additional period, you are entitled to terminate the contract. In cases where Breuninger has refused to deliver, or where delivery by the agreed date was essential, you may terminate the contract immediately without granting an additional period.
(5) Upon termination for non-delivery, Breuninger will reimburse all sums paid under the contract within 14 calendar days from the date of your notice of termination.
(6) The risk of accidental loss or damage to the goods transfers to you upon physical delivery of the goods to you or to a third party designated by you other than the carrier. If you have commissioned a carrier not proposed by Breuninger, the risk transfers upon handing over the goods to that carrier.
(7) At or after the time of delivery, Breuninger will provide you, on a durable medium, with confirmation of the concluded contract containing all information required under applicable law, to the extent not already provided before conclusion of the contract.
Section 7 Prices / Shipping costs
(1) The prices valid at the time of the order shall apply. All prices displayed in the Breuninger online shop RO include value added tax (VAT) at the applicable Romanian rate and all other applicable statutory taxes and charges, in accordance with Article 6 para. (1) let. (e) of GEO 34/2014.
(2) Applicable delivery and shipping fees are clearly stated during the order process, before you confirm your order. A summary of standard shipping costs is also available on the Shipping & Delivery section under Help pages. The total amount payable, inclusive of VAT and all delivery charges, will always be displayed before you submit your order.
(3) Where delivery costs cannot reasonably be calculated in advance, you will be informed of the basis for their calculation before placing the order. If Breuninger fails to inform you of additional delivery or other charges before you are bound by the contract, you are not obligated to pay those charges.
(4) Breuninger will not charge you any fees for the use of a particular means of payment that exceed the costs borne by Breuninger in connection with the use of that means of payment.
Section 8 Payment conditions and payment methods
(1) The following payment methods are available in the Breuninger online shop RO. The time of payment/charging varies depending on the respective payment method:
· Credit card: Your credit card will be charged upon completion of the order.
· PayPal: Your PayPal account will be charged upon completion of the order.
Additional payment methods may be made available over time and will be clearly indicated during the ordering process.
(2) Any charges beyond the agreed purchase price require your explicit consent and will not be imposed through pre-selected or pre-ticked options. If any such charge has been imposed without your explicit consent, you are entitled to reimbursement.
(3) Unless otherwise agreed, the payment of the purchase price becomes due immediately upon conclusion of the contract. In the event of payment default, statutory default interest will apply in accordance with article 1535 of the Romanian Civil Code and applicable Romanian law, calculated from the date payment fell due until the date of actual payment. Breuninger reserves the right to claim further compensation for additional damages caused by the payment default.
(4) All payments processed through the Breuninger online shop RO are handled through secure payment systems complying with applicable security standards. Breuninger does not store complete credit card data.
Section 9 Guarantee and legal conformity
(1) Breuninger is liable for any lack of conformity of the goods in accordance with Government Emergency Ordinance no. 140/2021 on certain aspects of contracts for the sale of goods (“GEO 140/2021”), implementing Directive (EU) 2019/771, and with the Consumer Code (Law no. 296/2004).
(2) Goods sold must be in conformity with the contract. A good is considered conforming if it meets both the subjective requirements of conformity (compliance with the contractual description, quantity, quality and functionality) and the objective requirements of conformity (fitness for the purposes for which goods of the same type are normally used; possession of the quality and performance typical of goods of the same type, etc.).
(3) In the event of a lack of conformity, you are entitled to: (a) repair or replacement of the goods, free of charge and within a reasonable period; (b) a proportionate reduction of the price; or (c) termination of the contract and full reimbursement of the purchase price, in the order and under the conditions provided by GEO 140/2021.
(4) The statutory guarantee period for conformity is 2 years from the date of delivery of the goods. During the first 12 months from delivery, any lack of conformity is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. Where Romanian law provides for a more favourable presumption period for the consumer in accordance with GEO 140/2021, that more favourable provision shall apply.
(5) You must notify Breuninger of any lack of conformity within 2 months of the date on which you discover it, in accordance with applicable Romanian law.
(6) Any commercial guarantee offered by the manufacturer or by Breuninger is in addition to, and does not affect, your statutory legal rights under this Section. The terms of any such commercial guarantee, including its duration, territorial scope and the identity of the guarantor, will be clearly communicated before or at the time of purchase.
(7) The exclusions from the right of withdrawal set out in Section 3 are without prejudice to your statutory guarantee rights under this Section, which remain fully unaffected.
Section 10 Liability
(1) Breuninger’s liability for damages is unlimited in cases of intentional misconduct or gross negligence, and for damages resulting from injury to life, physical integrity or health.
(2) In the event of a breach of material contractual obligations through ordinary negligence, Breuninger’s liability is limited to foreseeable and typically occurring damages.
(3) The above limitations do not apply where Breuninger has expressly guaranteed a specific quality or characteristic of a product, nor in cases governed by Law no. 240/2004 on the liability of producers for damage caused by defective products, as republished.
(4) Any limitation or exclusion of liability towards consumers that contravenes the mandatory provisions of Romanian or EU consumer protection legislation is null and void.
Section 11 Alternative Dispute resolution
(1) Alternative Dispute Resolution (ADR) in Romania: In accordance with applicable Romanian law on alternative dispute resolution — including the procedures managed by the Directorate for Alternative Dispute Resolution within the National Authority for Consumer Protection (ANPC) — consumers have the right to refer disputes arising from contracts with traders operating in Romania to an accredited ADR entity. Breuninger is willing to participate in alternative dispute resolution proceedings before a competent ADR body.
The competent ADR body for consumer disputes in Romania is the ANPC — Directorate for Alternative Dispute Resolution. Information on available ADR entities is accessible at: www.anpc.gov.ro.
(2) Right to approach ANPC and courts: You have the right to submit a complaint to the National Authority for Consumer Protection (ANPC) or to the competent Romanian courts, without being obligated to use ADR procedures first.

(3) Breuninger will make every reasonable effort to resolve consumer complaints amicably. Complaints may be submitted to: onlineshop-ro@breuninger.com. Breuninger will respond within 30 calendar days of receipt.
Section 12 Copyrights
The content and structure of the Breuninger online shop RO and all other websites operated by Breuninger are protected by copyright. All texts, pictures, graphics, audio, video, and animation files are subject to copyright law, trademark law and other laws for the protection of intellectual property laws, in accordance with Law no. 8/1996 on copyright and related rights, as subsequently amended. Some websites may also contain pictures, graphics, audio, video, and animation files that are subject to copyright law, trademark law and other laws for the protection of the intellectual property of the parties who provided them. Copying or other use apart from private, non-commercial use purposes or for disclosure, any other manner of publication, reproduction, and dissemination, whether in original or modified form and on any medium, or such a use on other websites, is not permitted without the express prior written consent of Breuninger.
Section 13 Data protection and privacy
(1) Breuninger processes your personal data in full compliance with Regulation (EU) 2016/679 (GDPR), Law no. 190/2018 implementing the GDPR in Romania, and Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector.

(4) Processing related to order fulfilment: Personal data collected in the context of your order (name, address, email, payment data) is processed on the basis of Article 6(1)(b) of the GDPR (performance of a contract) for the purpose of processing and fulfilling your order, managing returns and after-sales services, and complying with applicable legal obligations.
(5) Guest checkout and account registration: You may complete a purchase as a guest (without registering an account) or voluntarily create a customer account. Breuninger does not make the completion of a purchase contingent upon account registration, unless strictly required by the nature of the service (e.g., a subscription). Where you create an account voluntarily, you will be clearly informed of the specific purposes and legal bases for the processing of your account data. Customer accounts that have been inactive for a specific time period will be flagged for deletion, in compliance with the GDPR storage limitation principle.
(6) Processing related to returns monitoring: Breuninger collects and stores data on returned goods. To prevent excessive returns, Breuninger analyses this data for up to 12 months in the past and may contact consumers with high return rates with a view to finding a mutually satisfactory solution. This processing is carried out on the basis of Breuninger’s legitimate interest pursuant to Article 6(1)(f) of the GDPR; the legitimate interest pursued is the prevention of systematic contractual misuse and the protection of Breuninger’s commercial operations. A balancing test has been conducted confirming that this interest is not overridden by the consumer’s privacy rights, given the limited scope and duration of the data analysed.
(7) Marketing communications: Breuninger will only send direct marketing communications (including email newsletters and promotional messages) where you have given your prior, freely given, specific, informed and unambiguous consent pursuant to Article 6(1)(a) of the GDPR and Article 12 of Law no. 506/2004. You may withdraw consent at any time, free of charge and without giving reasons, by contacting Breuninger at onlineshop-ro@breuninger.com or by using the unsubscribe link included in every marketing message.
(8) Cookies: The Breuninger online shop RO uses cookies and similar tracking technologies. Non-essential cookies are placed only with your prior informed and specific consent, in accordance with Law no. 506/2004 and the GDPR. Detailed information is set out in Breuninger’s Cookie Policy, available on the platform.
(9) Your rights under the GDPR and Law no. 190/2018: You have the following rights in relation to your personal data:
• the right of access (Article 15 GDPR);
• the right to rectification (Article 16 GDPR);
• the right to erasure (“right to be forgotten”) (Article 17 GDPR);
• the right to restriction of processing (Article 18 GDPR);
• the right to data portability (Article 20 GDPR);
• the right to object to processing, including processing for direct marketing purposes (Article 21 GDPR);
• the right not to be subject to solely automated decision-making, including profiling (Article 22 GDPR).

Section 13 Final provisions
(1) Applicable law: These Terms are governed by Romanian law and, to the extent applicable, by EU law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. Any choice of German law does not deprive consumers habitually resident in Romania of the protection afforded to them by the mandatory provisions of Romanian law that cannot be derogated from by agreement. Where mandatory Romanian consumer protection provisions provide the consumer with greater protection, those provisions shall apply. These Terms have been updated to reflect the amendments introduced by Government Emergency Ordinance no. 18/2026, which transposes Directive (EU) 2024/825 (green transition consumer empowerment) and Directive (EU) 2023/2673 (distance contracts for financial services).
(2) Jurisdiction: In the event of a dispute that cannot be resolved amicably or through ADR, you may bring proceedings before the competent Romanian courts at your place of domicile, in accordance with Article 18 of Regulation (EU) no. 1215/2012 (Brussels I bis). Any clause purporting to confer exclusive jurisdiction on German courts to the detriment of consumers domiciled in Romania is not enforceable against those consumers.
(3) Severability: If any provision of these Terms is or becomes invalid, unlawful or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision reflecting as closely as possible the economic purpose of the original.
(4) Amendments: Breuninger reserves the right to amend these Terms. Material amendments will be communicated to registered consumers at least 30 calendar days before they take effect, by email or by prominent notice on the platform. Continued use of the platform after the effective date constitutes acceptance of the updated Terms. If you do not accept the amendments, you may terminate your user account without adverse consequences.
