Section 1 Scope

For the business relationship between E. Breuninger GmbH & Co. (Breuninger) and the party ordering goods from the selected online sales platform at the internet address www.breuninger.com (Breuninger online shop), the following Terms and Conditions (Terms) apply exclusively.

Section 3 Right of cancellation and cost bearing agreement

Section 4 Voluntary right of return

Apart from the statutory right of cancellation, Breuninger grants you a voluntary right of return according to the following provisions. This right of return gives you the option of withdrawing from the contract within a period of 30 days. This period starts the day after receiving the goods.

To avail of the voluntary right of return, you must send the goods back to Breuninger within the deadline mentioned above.

Return shipment must be directed to the Breuninger address that is named in the return papers enclosed with the delivery.

On-time shipment is sufficient for observation of the deadline.

We reserve the right to refuse to take back goods if you fail to comply with the above requirements.

We only grant you the voluntary right of return subject to the condition that the goods are in faultless conditions upon return.

Section 5 Reservation of title

(1) The goods remain the property of Breuninger until full payment has been made.

(2) Notwithstanding paragraph 1, for partner products, delivery of the goods is subject to the respective partner’s retention of title. Within the scope of the business relationship with the relevant partner, Breuninger is authorized to assert this retention of title against customers. The delivered goods remain the property of the respective partner until all claims arising from the business relationship conducted through us have been paid, regardless of the legal basis.

Section 6 Delivery

Delivery is restricted geographically to the country of the respective country shop that was selected. No deliveries will be made to delivery addresses in a delivery region that is excluded according to paragraph 2.

Netherlands: Deliveries to Aruba, Bonaire, Curacao, Sint- Maarten, Saba, Sint Eustatios

Section 9 Terms and Conditions of Participation in Beyond

1 Subject matter of the agreement

(1) These Terms and Conditions govern participation in the 'Beyond by Breuninger' loyalty program (hereinafter: loyalty program) of E. Breuninger GmbH & Co., Marktstr. 1-3, D-70173 Stuttgart (hereinafter: Breuninger). 

(2) Participation in the loyalty program is currently limited to purchases made in the online shop via breuninger.com/nl. By participating in the loyalty program, you collect points depending on the value of your online purchases. You can redeem the points on future purchases or use them to collect Beyond Activities Points (see section 2 of the terms of participation). The more Beyond Activities Points you collect, the higher your level. Each level entitles you to different rewards (see section 3 of these Terms and Conditions). 

(3) Membership is free of charge and open to natural persons over the age of 18 residing in the European Economic Area and/or Switzerland. Legal entities are excluded from participation. There is no legal entitlement to participate in the loyalty program. Breuninger reserves the right to refuse participation of persons at any time.

(4) To participate in the loyalty program, you must create an account via breuninger.com/nl. During registration, you will be asked to provide a valid email address so that we can send you a confirmation email. You can also indicate whether you wish to receive our newsletter. We can only send you our newsletter if you have given your consent to receive it and confirmed your choice via the link in the confirmation email. You may withdraw your consent at any time. The newsletter (also) contains information about the loyalty program. If you do not wish to receive newsletters, you can view information about the loyalty program, such as vouchers and rewards, in your online account. Information regarding your accumulated points will always be sent to the email address you have provided.

(6) These Terms and Conditions apply between Breuninger and every Beyond Member. Any conflicting terms and conditions shall not be recognized. These Terms and Conditions may be viewed, saved, and printed at any time via the website. The contract and all communication are concluded in German. 

2 Collecting points

(1) A Beyond Member is awarded points depending on the value of their online purchases via breuninger.com/nl. Points can be redeemed on future purchases. The current points balance can be viewed in your online account. More information can be found here.  

(2) The points will be credited to your online account no later than four weeks after the 30-day return period has expired. The current points balance can be viewed in your online account. Any objections regarding the accuracy of the points awarded must be submitted in writing via our contact form within four months of the points being credited to your online account.  

(3) If it subsequently determined that points have been awarded even though applicable conditions have not been met, for example because a purchase was returned or otherwise cancelled —Breuninger may reverse the points and correct the point balance.  

(4) Breuninger reserves the right to amend the conditions for awarding points and/or the value of points. In that case, points already awarded will remain valid in accordance with the conditions that applied at the time they were awarded. 

3 Collecting points

(1) Members can collect points by making purchases or by participating in Beyond activities (for example, signing up for the newsletter). Depending on the number of points, members reach a corresponding level. Each level is associated with different rewards. Once the threshold for the next level (see here) has been reached, the level is automatically updated. If the number of points decreases, the level may be adjusted downwards. If a member has given their consent, they will be informed by email when they reach a different level. Information about levels and points balances is also available via the online account.

(4) Breuninger reserves the right, with future effect, to amend, limit, or discontinue the conditions for awarding points, the level, and the rewards to be granted at any time with future effect. Points and rewards already granted shall remain valid.

(5) Points are valid for a period of 12 months from the date they are awarded and will automatically expire thereafter.

4 Obligations of Care and Cooperation

(1) Membership in the loyalty program is personal and may not be transferred. Points are non-transferable and cannot be exchanged for cash.

(2) In the event of suspected misuse, the online account may be blocked immediately and all points may be deleted. Members are obliged to inform Breuninger as soon as possible in the event of unauthorized or improper use.

(3) Members are obliged to notify Breuninger as soon as possible of any changes to their name, address, email address, or other information provided when creating an online account, or to update such information themselves where possible. Members acknowledge that important communications will be sent to the most recently provided email address.

5 Personal data

(1) Personal data is processed in accordance with Breuninger's privacy policy, which can be viewed, saved, and printed via the website.

(2) The processing of members' personal data for marketing or market research purposes by Breuninger (for example, sending customer-specific offers and information), including on the basis of information relating to points (such as purchased items, prices, number of points, place and date of purchase, use of rewards, level information, purchase data, interests, and online user behavior), only occurs if the respective member has given their consent. Consent is provided by means of a separate declaration of consent and is not a prerequisite for participation in the loyalty program. Members may withdraw their consent at any time. 6 Liability

(1) Breuninger shall have unlimited liability in cases of intent, fraudulent intent, and gross negligence, as well as in the event of personal injury and/or death.

(2) To the extent permitted by law, Breuninger shall not be liable for indirect damages. In case of direct damages, Breuninger's liability is limited to the amount payable to Breuninger under the applicable agreement with the customer or, if there is no current agreement, the most recent agreement between the customer and Breuninger. In such cases, Breuninger shall not be liable for loss of profits, consequential damages, and/or third-party claims.

7 Amendments and Discontinuation of the Loyalty Program

(1) Breuninger reserves the right to amend these Terms and Conditions where the amendments are minor and/or commercially justified changes. This includes an expansion of the opportunities for collecting and redeeming points, an extension of the expiry date of points, changes to the periods for terminating/cancelling participation in the loyalty program in favor of the Beyond Members, as well as editorial or stylistic adjustments. In such cases, the new Terms and Conditions will only apply if (1) Breuninger has informed the member of the amendments in writing or electronically by email; and (2) the member has not objected to the amendments within one month of receiving the notification of the amendments. Breuninger will explicitly inform the member of the legal consequences of failing to object. If a member does not accept the new Terms and Conditions, this shall be deemed a termination of the agreement in accordance with section 8 of these Terms and Conditions.

(2) Breuninger also reserves the right to discontinue the loyalty program after a period of twelve months. In this case, members are entitled to redeem the accumulated points or claim the reward associated with their respective level within a period of 12 months after the termination of the loyalty program. After this period, the points and rewards will expire.

8 Term and Termination

(1) The agreement is concluded for an indefinite period.

(2) The member may terminate the agreement at any time without a notice period via the online account or via the contact form. In the event of termination by the member, accumulated points can be redeemed or the rewards based on the respective level can be claimed for a period of twelve (12) months from the moment of termination. Thereafter, the points and rewards will expire. From the moment of termination, it is no longer possible to collect points.

(3) Breuninger may terminate the agreement governing participation in the loyalty program subject to a notice period of four (4) weeks. The agreement will then expire at the end of the respective calendar month. Breuninger may terminate or dissolve the agreement with immediate effect for a valid reason. This includes, for example, cases involving misuse of the loyalty program.

(4) Where Breuninger terminates the agreement, members may redeem the accumulated points or claim the rewards within a period of twelve (12) months after the termination takes effect. After this period, the points and rewards will expire. From the moment of termination, it is no longer possible to collect points.

(5) In the event of termination or dissolution by Breuninger for a valid reason, members may redeem accumulated points or claim the rewards within a period of six (6) months after the termination or dissolution. From the moment of termination or dissolution, it is no longer possible to collect points.

9 Final provisions

(1) This agreement is governed by the laws of the Netherlands. To the extent applicable, the UN Convention on Contracts for the International Sale of Goods (CISG) and the rules of private international law shall be excluded.

Section 10 Guarantee

Breuninger is liable for material and legal defects according to the applicable legal regulations, particularly Sections 434 et seq. of the German Civil Code (BGB). The limitation period is two years pursuant to Section 438 (1) no. 3 of the BGB and begins upon delivery of the goods.

A restriction of your cancellation right pursuant to Section 3 is not associated with the regulations outlined here.

Section 11 Dispute resolution

Breuninger is willing to participate in dispute resolution proceedings before a consumer arbitration board.

Section 12 Copyrights
